Terms of Service

These Terms of Service (“Agreement”) constitute a legally binding contract between you (“Customer,” “Client,” “User,” or “You") and Qixla Cloud ("Qixla," "We," "Us," or "Our"), governing your access to and use of the services offered by Qixla Cloud, including but not limited to virtual private servers, dedicated servers, application hosting, web hosting, mail server hosting, and game hosting (collectively, the "Services").

By creating an account with Qixla Cloud, using our Services, or otherwise indicating acceptance of this Agreement, you agree to be bound by these Terms of Service. If you do not agree, you must not use our Services.

1. Eligibility and Account Registration

  1. To use the Services, you must create an account by providing your name, email address, and nationality. You are responsible for ensuring the accuracy of the information provided.
  2. Customers may share account access with authorized persons; however, you remain fully responsible for all activities conducted under your account.
  3. You must be at least 18 years of age or the legal age of majority in your jurisdiction to register.

2. Services and Usage Limits

  1. Qixla Cloud offers hosting solutions including VPS, dedicated servers, application hosting, web hosting, mail server hosting, and game hosting, subject to the specifications of your selected plan.
  2. Each plan includes defined limits for bandwidth, storage, CPU, memory, and other resources as specified on our website. Exceeding these limits may result in service suspension or additional charges.

3. Payments and Billing

  1. Payment Methods: We accept PayPal, credit cards, debit cards, and UPI.
  2. Billing Cycles: Services are billed on a monthly, quarterly, or annual basis, as chosen at the time of subscription.
  3. Refunds: Qixla Cloud has a strict no-refund policy, except in the event of service downtime exceeding six (6) hours within a calendar month. In such cases, Customers will be reimbursed for the downtime period. If total downtime exceeds six (6) hours, the Customer may apply for a refund.
  4. Non-Payment: Failure to pay invoices by the due date will result in immediate suspension of Services. Data associated with suspended accounts will be permanently deleted and is not recoverable.

4. Acceptable Use Policy (AUP)

Customers are strictly prohibited from using the Services for:

  • Hosting or distributing illegal content;
  • Sending spam or phishing communications;
  • Hosting or promoting adult material;
  • Resource abuse or disruptive activities;
  • Copyright infringement or intellectual property violations;
  • Cryptocurrency mining.

Customers may engage in reseller hosting, provided that sub-users also comply with this Agreement.

5. Service Availability and Support

  1. Qixla Cloud guarantees a 99.9% uptime for all hosting services.
  2. Support requests must be submitted through our ticketing system and will be addressed within twenty-four (24) hours, though most are handled sooner.
  3. Qixla Cloud does not warrant uninterrupted or error-free operation of the Services, and shall not be liable for downtime caused by circumstances beyond its reasonable control.

6. Data and Privacy

  1. Customer Responsibility: Customers are solely responsible for backing up their data. Qixla Cloud is not liable for loss, corruption, or deletion of data.
  2. Privacy Policy: By using our Services, you consent to the collection and use of personal information as outlined herein. We collect limited personal data (name, email, nationality, and billing information) solely for account administration and service provision. We do not sell or share your data with third parties, except where required by law.
  3. Law Enforcement Requests: Qixla Cloud does not voluntarily disclose Customer data to law enforcement. Disclosure will only occur if legally required under Indian law.

7. Suspension and Termination

  1. Qixla Cloud may suspend or terminate Services in the following circumstances:
    • Non-payment of fees;
    • Violation of this Agreement or the AUP;
    • Legal orders or regulatory requirements.
  2. Except in urgent cases, Customers will be provided with notice prior to suspension or termination.

8. Limitation of Liability

  1. To the maximum extent permitted by law, Qixla Cloud shall not be liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.
  2. In no event shall Qixla Cloud’s aggregate liability exceed the total fees paid by the Customer in the twelve (12) months preceding the claim.

9. Indemnification

The Customer agrees to indemnify, defend, and hold harmless Qixla Cloud, its operators, affiliates, and contractors against any claims, damages, liabilities, costs, or expenses arising from the Customer’s use of the Services, violation of this Agreement, or infringement of third-party rights.

10. Governing Law and Dispute Resolution

  1. This Agreement shall be governed by and construed in accordance with the laws of India.
  2. Any disputes arising under or in connection with this Agreement shall be resolved individually (not as part of a class action) in the competent courts of Hyderabad, India.

11. Modifications

Qixla Cloud reserves the right to update, modify, or revise these Terms of Service at any time without prior notice. Continued use of the Services after changes are posted constitutes acceptance of the revised Terms.

12. Entire Agreement

This Agreement constitutes the entire agreement between the Customer and Qixla Cloud regarding the Services and supersedes all prior or contemporaneous communications and proposals, whether written or oral.
